- Privacy Policy - the document describing how the Operator processes personal data.
§2. General provisions
- These Terms set out the rules for using the Hauspot app.
- Using the app is free of charge.
- Using the app requires a device running Android 7.0 (API level 24) or later, or iOS 16.4 or later, and internet access.
- Users may not supply unlawful content through the app.
- These Terms are available free of charge on the Hauspot website and in the app, including before an Account is created.
- Contact with the Operator: kontakt@hauspot.pl.
§3. Using the app without an Account
- The map, the list of Venues, Venue profiles and Reviews are available without an Account.
- Using the app without an Account is governed by these Terms, except for the provisions about Accounts.
§4. Account
- An Account can be created with an email address and a password, or by signing in with Google or Apple.
- Creating an Account requires accepting these Terms and confirming that the Privacy Policy has been read.
- When the Account is created, the User and the Operator enter into an agreement for keeping the Account, for an indefinite period.
- Each person may have one Account.
- Anyone may create an Account. A person under 16 creates an Account with the consent of a parent or legal guardian (Art. 8 GDPR). Browsing Venues without an Account requires neither an Account nor such consent.
- The User keeps their Account's sign-in details confidential.
§5. Deleting the Account
- The User may delete their Account at any time in the Account tab of the app.
- After a deletion request the Account stops being visible at once, and the Operator erases its personal data after 30 days. Until then the User can restore the Account by signing in. After that the deletion is irreversible.
- The User's Reviews remain in Hauspot without their name, as "Deleted user".
- Deleting the Account terminates the agreement for keeping the Account.
§6. Reviews
- Only a User with an Account may add a Review.
- A User may add one Review of a given Venue.
- A Review consists of a rating from 1 to 5 and an optional comment.
- A Review describes the User's own experience of the Venue.
- A Review may not contain offensive, unlawful or promotional content, or other people's personal data.
- The Operator has zero tolerance for offensive content, harassment or other abuse. For such content it hides Reviews and may block the adding of Reviews.
- The author may edit or delete their Review at any time.
- By adding a Review, the author grants the Operator a non-exclusive, royalty-free licence to display it in Hauspot in the app and on the website, without territorial limits, for as long as the Review is published. The licence continues after the Account is deleted.
§7. Moderation of Reviews
- A User with an Account may report a Review that breaches these Terms.
- The Operator checks a report within 24 hours and hides a Review that breaches these Terms. The author is told the reason it was hidden.
- The Operator may block a User from adding and editing Reviews when their Reviews breach these Terms. It then hides their Reviews and gives them the reason in an e-mail.
- The author can still see their hidden Review.
- A hidden Review does not count towards the Venue's rating.
- A User may hide the Reviews of a chosen author for themselves and undo this in the Account settings. The Operator then receives information about that Review.
- Objections to a hidden Review or to a block can be sent to kontakt@hauspot.pl.
§8. Information about Venues
- Venue information is supplied by Venue Owners or by the Operator.
- Before a Venue is published, the Operator checks what the Venue offers to pets.
- Opening hours, prices and menus may change. The Operator does not guarantee they are up to date.
- Whether a pet is admitted is the Venue's decision.
- The Operator is not a party to the relationship between a User and a Venue.
§9. Favourites
- Favourites are visible only to the User who saved them.
- Favourites are deleted together with the Account.
§10. Liability
- The Operator is liable to the User within the limits set by law.
- Hauspot is in testing. The app may be unavailable at times, in particular during technical work.
- The Operator is not liable for the content of Reviews or for Venue information provided by Venue Owners, unless it knew of its unlawful nature, or, after a credible notice of it, failed to hide it without delay. The Operator is also not liable for damage resulting from interruptions in the app caused by reasons beyond its control.
- Nothing in these Terms limits the User's rights as a consumer.
§11. Complaints
- Complaints about the app can be sent to kontakt@hauspot.pl.
- A complaint should describe the problem and give the Account's email address, if it concerns an Account.
- The Operator replies to a complaint within 14 days.
- A User who is a consumer may use out-of-court complaint and redress procedures, in particular mediation, an arbitration court, or the help of a county (municipal) consumer ombudsman or a consumer organisation. Information about them is published by the Office of Competition and Consumer Protection (uokik.gov.pl).
§12. Personal data
The rules for processing personal data are set out in the Privacy Policy.
§13. Changes to these Terms
- Every change to these Terms is a new version with the date it takes effect.
- Earlier versions of these Terms remain available on the Hauspot website.
- The Operator announces a material change at least 14 days in advance.
- After a material change, the app asks for the new version to be accepted. Until it is, Reviews and Favourites cannot be added.
- A User who does not accept the changes may delete their Account.
§14. Final provisions
- These Terms are governed by Polish law.
- In case of discrepancies between the language versions, the Polish version prevails.
- Contact with the Operator: kontakt@hauspot.pl.
- These Terms apply from the date given as the version's date.
